Community Educator Learning Hub Registered Users

These Terms & Conditions for ASU’s Mary Lou Fulton Teachers College, Community Educator Learning Hub (the “Hub”) Registered Users (“Terms & Conditions”), are provided by the Arizona Board of Regents for and on behalf of Arizona State University (hereafter, “ASU”). “You” or “Subscriber” or “User” means anyone using the site or registering for a user account.

  1. Definitions
    “Registered User” means an individual site user who has registered for an account.
    “Purchaser” means a person or entity that has purchased a subscription to the Hub, whether for an individual Registered User or on behalf of a group of Registered Users.
    “Organizational User” means a Registered User who has been provided an Organization Code to register for an account.
  2. Terms
    By using this site or registering for a user account on ASU’s Community Educator Learning Hub, you are accepting and agreeing to be bound by these Terms & Conditions, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained on the Community Educator Learning Hub are protected by applicable copyright and trademark law.
  3. Use License
    • License Grant. Pursuant to these Terms & Conditions, ASU grants you permission to temporarily download one copy of any downloadable materials on the Community Educator Learning Hub for personal, non-commercial, transitory viewing only. ASU retains all right, title and interest in and to all such materials. This is the grant of a license, not a transfer of title, and under this license you may not:
      • modify or copy the materials;
      • use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
      • attempt to decompile or reverse engineer any software contained on the Community Educator Learning Hub web site;
      • remove any logos, trademarks, copyright, attributions, or other proprietary notations from the materials; or
      • transfer the materials to another person or entity, or ‘mirror’ the materials in any manner, including without limitation on any other server.
    • Prohibited Conduct. Except as expressly set forth herein, neither Subscriber nor the Users may (a) copy, reproduce, alter, modify, transmit, perform, create derivative works of, publish, sub-license, distribute, or circulate the Website, the Content, or any portion thereof; (ii) disassemble, decompile, or reverse engineer the Website or any portion thereof, or use a robot, spider, or any similar device to copy or catalog the Content or any portion thereof; (iii) take any actions, whether intentional or unintentional, that may circumvent, disable, damage or impair the Website’s or the Content’s control or security systems, nor allow or assist a third party to do so; or (iv) use the Content in a manner that disparages the Website, the Content or ASU or its content providers, or in any manner that ASU may, in its sole discretion, deem inappropriate.
    • Equitable Relief. Subscriber and the Users acknowledge and agree that the Website and the Content possess a special, unique and extraordinary character that makes difficult the assessment of the monetary damages that would be sustained as a result of unauthorized use, and that unauthorized use may cause immediate and irreparable damage to ASU for which ASU would not have an adequate remedy at law. Therefore, Subscriber agrees that, in the event of such unauthorized use, in addition to such other legal and equitable rights and remedies as may be available to ASU, ASU shall be entitled to seek injunctive and other equitable relief without the necessity of proving damages or furnishing a bond or other security.
    • This license shall automatically terminate if you violate any of these restrictions or the Terms & Conditions, and ASU may terminate the license at any time, for any reason. Upon termination of your access these materials for any reason, or upon the termination of this license, your license is terminated and you must destroy any and all materials in your possession whether in electronic or printed format.
  4. Disclaimer
    The materials on the Community Educator Learning Hub are provided ‘as is’. ASU makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, ASU does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.
  5. Limitations
    In no event shall ASU be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on the Community Educator Learning Hub, even if ASU or an authorized representative of ASU has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
  6. Revisions and Errata
    The materials appearing on the Community Educator Learning Hub may include technical, typographical, or photographic errors. ASU does not warrant that any of the materials on its Website are accurate, complete, or current. ASU may make changes to the materials contained on its web site at any time without notice. The Community Educator Learning Hub does not, however, make any commitment to update the materials.
  7. Links
    The Community Educator Learning Hub has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by ASU. Use of any such linked website is at the Registered User’s own risk.
  8. Site Terms of Use Modifications
    The Community Educator Learning Hub may revise these Terms & Conditions for its Website at any time without notice. By using this Website you are agreeing to be bound by the then current version of these Terms & Conditions.
  9. Governing Law
    Any claim relating to the Community Educator Learning Hub shall be governed by the laws of Arizona without regard to its conflict of law provisions.
  10. Purchases made on the Community Educator Learning Hub
    Purchases made for nanocourse materials (e.g., annual subscription) are available for use only by Purchaser, and its Users if applicable,, and may not be transmitted, distributed, or otherwise shared with any other person. The purchased course and associated materials are available to the Purchaser, and its Users if applicable, for a period of one year from the date of purchase unless otherwise specified in writing. Upon expiration of the subscription, you shall delete or destroy all materials pursuant to Section 2, above.

Privacy Policy

This Privacy Policy, along with ASU’s Privacy Statement (https://www.asu.edu/about/privacy),  governs the manner in which the Community Educator Learning Hub collects, uses, maintains and discloses information collected from Registered Users of the Community Educator Learning Hub. This Privacy Policy applies to the Community Educator Learning Hub and all content available on the Community Educator Learning Hub.

Information We Collect

We collect personally identifiable information from Registered Users in a variety of ways, including, but not limited to, when Registered Users register for a user account on the Community Educator Learning Hub, enroll in a Course within the Community Educator Learning Hub, subscribe to a newsletter, or in connection with other activities, services, features, or resources we make available on Community Educator Learning Hub. Registered Users must supply personal identification information in order to register an account on the Community Educator Learning Hub. Registered Users who register for a user account on the Community Educator Learning Hub through the use of an Organization Code agree to share personally identifiable information with ASU as well as the Purchaser of the Organization Code.

We use a third-party to process payments and we do not collect your payment information. 

How we use collected information

The Community Educator Learning Hub may collect and use Registered Users’ personally identifiable information for the following purposes:

  • To improve customer service – Information you provide helps us respond to your customer service requests and support needs more efficiently.
  • To personalize user experience – We may use information to personalize the experience of Registered Users.
  • To send periodic emails – We may use Registered Users’ email addresses to send Registered Users information and updates pertaining to their account or activity on the Community Educator Learning Hub. Registered Users email addresses may also be used to respond to Registered Users inquiries, questions, or other requests. We may also use Registered email addresses to send Registered Users information related to ASU’s Mary Lou Fulton Teachers College. You may “unsubscribe” from emails, or to opt out, please email: MLFTCTechOps@asu.edu.
  • For research and development – We may de-identify and/or aggregate Registered User data with other Registered Users’ data and use the de-identified and/or aggregated data for any lawful purpose including but not limited to assessing, improving, and developing our Services, business, and for other analytics, marketing, and research purposes.

Sharing your personal information

We do not sell, trade, or rent Registered Users personal identification information to others. We share Organizational Users’ personally identifiable information with the related Purchaser or Organization. We share aggregated or de-identified information for research and educational purposes, and for other purposes related to ASU’s mission. 

Third party websites

Registered Users may find advertising or other content in our Community Educator Learning Hub that link to the websites and services of our partners, suppliers, advertisers, sponsors, licensors and other third parties. We do not control the content or links that appear on these websites and are not responsible for the practices employed by websites linked to or from our Community Educator Learning Hub. In addition, these websites or services, including their content and links, may be constantly changing. These websites and services may have their own privacy policies and customer service policies. Browsing and interaction on any other website, including websites which have a link to the Community Educator Learning Hub, is subject to that website’s own terms and policies.

Changes to this Privacy Policy and the Terms & Conditions

ASU has the discretion to update this Privacy Policy and Terms & Conditions at any time. We encourage Registered Users to frequently check this page for any changes. You acknowledge and agree that it is your responsibility to review this Privacy Policy and the Terms & Conditions periodically and become aware of modifications.

Your acceptance of these terms

By registering for a user account on the Community Educator Learning Hub, you signify your acceptance of this Privacy Policy and Terms & Conditions. If you do not agree to this Privacy Policy or the Terms & Conditions, please do not register for an account on the Community Educator Learning Hub. Your continued registration on the Community Educator Learning Hub following the posting of changes to this Privacy Policy and Terms & Conditions will be deemed your acceptance of those changes.
